Deposit & Cancellation Policy *

Deposits are non-refundable. We understand that life happens and things come up. Should you need to cancel or reschedule, we require at least 8 days from date of charter written notification for a refund of non-deposit payments. Cancellations within seven days will be refunded 50% of non-deposit payment. Cancellations within 48 hours of check-in and no-shows will not be refunded. COVID-19 POLICY UPDATE If your travel plans are interrupted due to COVID-19 related travel restrictions, or if we need to cancel your trip due to restrictions in our area, you will receive a full refund (minus deposit and any payment / refund processing fees) Deposit payments can then be used toward any future QMT trip.

Weather Policy *

Q+M Travels reserves the right to alter planned itinerary or reschedule any booking due to bad weather. The Captain has the final decision on all matters of safety, and has the right to cut a trip short and return to the safety of the dock or anchorage if he/she deems the weather conditions to be dangerous. We keep a very close eye on weather forecasts and can usually make a call 48 hours in advance. Your safety and the safety of Esprit and her crew are our top priority. Trips will not be refunded due to bad weather, but can be rescheduled for the same type of booking at no additional cost.

Captain's Authority *

Our top priorities at Q+M Travels are safety and providing a fun experience. While we encourage our guests to engage and play and active part in sailing, the Captain has absolute authority when it comes to safety, navigation, and seamanship. Guests are required to comply with reasonable orders from the Captain and crew regarding safety matters. The Captain reserves the right to make changes to the itinerary should the weather or other factors render such changes reasonably necessary.

Illegal Substances Policy *

Under NO circumstances are illegal substances permitted on board Esprit. We can not stress this policy strongly enough. Any passenger bringing illegal substances on board will be held financially responsible for any and all damages resulting from such action, including but not limited to: the entire cost of vessel due to confiscation by authorities, loss of business income due to any vessel down-time, liability for any resulting injuries, any and all legal fees, fines, or other penalties and costs incurred as a result of any violations of this policy. Our captain and crew are bound by U.S. Coast Guard Rules to immediately report all use or possession of illegal substances to authorities and will do so without hesitation. While cannabis products are legal in many Q+M Travels charter locations, including California, cannabis is still illegal under U.S. Federal law and U.S. Coast Guard regulations. Cannabis products of any sort will not be permitted aboard Esprit or any Q+M Travels charter. Thank you for your understanding.

Alcohol Policy *

You may bring alcoholic beverages (please avoid glass), but any passenger consuming alcohol must be at least 21, and passengers assume all legal and other consequences of illegal alcohol consumption. Should a guest become intoxicated, or show up intoxicated, the captain reserves the right to deny service or return the offending individual and accompanying group to the harbor. No rescheduling will be available and no refunds will be issued for charters shortened or cancelled due to intoxicated guests. It’s nice to enjoy a few drinks while out for your sail, but intoxicated individuals create unsafe and uncomfortable conditions for all. We want everyone to have a fun, safe, and memorable sail.

Young Shipmate Policy *

Please let us know in advance the number and ages of anyone under age 18 you plan to bring aboard your sail. We need to ensure ahead of time that there is a reasonable number of adults for the number of children on board. Adult guests are ultimately responsible for their children’s safety, conduct, and entertainment. Q+M Travels has a limited number of children’s PFDs (personal flotation device) and you may be asked to supply your own.

Swimming Policy *

Should you decide to go swimming, you acknowledge that you assume all risks. Please tell us in advance of your charter if you think you may want to swim. The captain reserves the right, in his or her sole discretion, to not allow swimming, and swimming is only permitted during full daylight hours while the boat is anchored or on a mooring ball. Swimming is never allowed while the boat is moving (underway). Be aware that cold water temperatures and currents may be dangerous. Any adult that gives a minor in his/her care permission to swim is solely responsible for the safety of said minor. At least one adult guest per child in the water must be present.

Assumption of Risk and Complete Release of Liability *

Please read carefully before agreeing below. By signing this Agreement, each person participating in a sailing Experience expressly waives all claims against Mitchell Andrus, Quincey Cummings, and Q+M Travels LLC, including their reservation/booking agent, crew, employees, partners and any other agents or affiliates (hereinafter “Q+M Travels”) for injury, accident, illness or death during or by reason of their joining a sailing Experience on the sailing vessel Esprit or any other partnered vessel, according to the language below: “Sailing involves inherent risks that cannot be eliminated without altering the fundamental nature of the sailing activity. I ACKNOWLEDGE that in consideration for being allowed to participate in this sailing experience with Q+M travels, on behalf of myself and my next of kin, heirs and representatives, I hereby release from any and all liability and promise not to sue Mitchell Andrus, Quincey Cummings, and Q+M Travels LLC, including their crew, employees, partners and any agents, (hereinafter “Q+M Travels”) for any and all claims, including claims against Q+M Travels for negligence resulting in any physical or psychological injury or illness (including but not limited to paralysis and death), property damage, or any other economic or emotional loss or trauma I may suffer because of my participation in this sailing activity, including travel to, from, and during the activity. I am voluntarily participating in this sailing activity. I am aware of the risks associated with traveling to, from, and participating in, this sailing activity, which include but are not limited to physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, and/or death. I voluntarily and knowingly assume the risk of any dangers that may arise at all stages of the sailing experience, including but not limited to, slips, falls, burns, cuts, sea sickness, falling overboard, high winds, lightning, collision of vessels, shipwreck, unseaworthiness of the vessel, drowning, exposure to cold weather, exposure to dangerous marine life, and a host of other risks which cannot all be listed in this agreement. I am also aware and clearly understand that Mitchell Andrus , Quincey Cummings, and Q+M Travels LLC will have no liability regarding the provision of any medical care or the adequacy of any care that may be rendered. If I need medical treatment, I agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance. I understand that although Q+M Travels LLC may make suggestions as to air carriers and travel agents, they assume no liability for injury, damage, delay, irregularity or loss of baggage relating to airline travel. I understand that the above-referenced injuries or outcomes may arise from my own or other’s actions, inaction, or negligence; conditions related to travel; or the condition of the ocean, marina and other sailing locations. Nonetheless, I assume all related risks, both known or unknown to me, and enter into this Agreement on behalf of all members of my family, including any minors accompanying me. If any person who accompanies me on this trip as part of my family makes claim, or if a claim is made on their behalf, my estate or I will indemnify and hold harmless Q+M Travels LLC from any loss, including reasonable attorney's fees incurred in the defense of such claim. I have read the TERMS AND CONDITIONS supplied to me by Q+M Travels, and agree to abide by these rules on board or ashore, for the duration of the expedition. I am 18 years or older (if under 18, my parent or legal guardian has agreed on my behalf). I understand the legal consequences of signing this document, including (a) releasing the Q+M Travels from all liability, (b) promising not to sue Q+M Travels, (c) and assuming all risks of participating in this sailing activity, including travel to, from and during the Activity. I understand that this document is written to be as broad and inclusive as legally permitted by the State of California. This Agreement is binding upon my heirs, legal representative and assigns. I agree that if any portion is held invalid or unenforceable, the remaining portions shall remain in full force and effect. I have read this document, and I am signing it freely. No other representations concerning the legal effect of this document have been made to me. I execute it voluntarily and with full knowledge of its significance.
